Terms of Service

These Terms govern your use of the NextMate mobile application. The Privacy Policy is a separate page: read it here.
1. Acceptance of Terms
By creating an account or using the NextMate mobile application ("NextMate," "the App," "we," "us"), you agree to these Terms of Service ("Terms") and the Privacy Policy in Part Two. If you do not agree, do not use the App.
2. What NextMate Is — and Is Not
NextMate is a community platform for drivers. It has two modes: Everyday Driver, which helps a driver leaving a parking space communicate its availability to a nearby driver searching for one; and Commercial Driver, which offers community-shared parking locations and notes, Road Alerts, a user-to-user Marketplace, and a Driver Card.
NextMate does not own, manage, lease, or control any parking space, lot, garage, road, or item listed by a user.
NextMate does not guarantee that a parking space will be available, that a match will occur, or that a matched space will still be open when you arrive. Every match is tentative, not reserved, because a vehicle that is not using the App could occupy the space first. NextMate is not responsible for the unavailability of a space for any reason.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if older, to create a NextMate account. You must hold a valid driver's license appropriate to any vehicle you operate while using the App, and you must have the legal right to operate and park any vehicle you register.
4. Your Account and Signing In
You sign in with your email address. NextMate sends a one-time sign-in link to that address. Anyone with access to your email inbox may be able to sign in as you, so keep it secure.
You may optionally add a backup phone number for signing in. If you do, NextMate sends a one-time verification code by text message through a third-party provider. These messages are used only for signing in and verification. Message and data rates from your carrier may apply. You are responsible for providing a phone number that you own and can access, and you may ask us to remove it at any time.
You agree to provide accurate information when creating your account, including your name, date of birth, contact information, and vehicle details, and to keep it current. You are responsible for all activity under your account.
Your account may also have a public username (a handle). Choose one that does not impersonate anyone or contain personal information you do not want others to see. We may require you to change a username that violates these Terms.
5. Location Services
NextMate needs access to your device's location to work. It uses your location while the App is in use to record where you parked, to confirm you are near your vehicle when you signal that you are leaving, to find nearby drivers, to show nearby Road Alerts, and to fill in the location of a report you create. NextMate does not currently track your location in the background. You may turn off location access in your device settings, but core features will stop working.
Maps in the App are provided by Google, and address lookups use your device's built-in location services. Those services have their own terms and privacy practices.
6. Conduct and Safety
Never use the App while driving. Only report, browse, or interact with the App when you are safely stopped.
NextMate is built around cooperation, not confrontation. If a parking space assigned to you or another user is taken by a driver who is not using NextMate, you agree not to confront, argue with, or attempt to physically prevent that driver from using the space. The App provides a reporting option for this situation, and using it is the expected response.
You agree not to:
- Provide false information about your vehicle, location, identity, or eligibility for any setting
- Trigger a "leaving" or "arriving" signal without a genuine intent to follow through
- Manipulate the priority, badge, referral, rating, or voting systems, including through fake or repeated activity
- Harass, threaten, or endanger another user
- Attempt to identify or contact a matched user beyond what the App shows you
- Post spam, false reports, or content that is unlawful, misleading, or infringes someone’s rights
- Interfere with the App's security or operation, or use it for any unlawful purpose
7. Accessible Parking Permit Setting
The App lets you indicate that you hold a valid accessible (disability) parking permit. This setting is optional and self-reported. NextMate does not verify permits and does not determine anyone’s eligibility.
By turning this setting on, you confirm that you hold a valid permit issued to you and that you will use accessible spaces only as the law allows. Misusing an accessible space, or misrepresenting your eligibility, may violate the law and these Terms, and may result in fines, towing, or removal of your account. NextMate is not responsible for whether any particular space is legally designated or available for your use.
8. Referral Program
NextMate may offer a referral program in which the user who shared a referral code receives a temporary priority benefit when a new user completes registration using that code. NextMate may modify, limit, or discontinue the program, or deny or revoke benefits obtained through fraudulent activity, at any time.
9. Priority Scores, Badges, and Ratings
Priority scores, badge tiers, and ratings reflect in-app standing only. They have no cash value, cannot be sold or transferred, and do not guarantee any specific match outcome.
10. Parking Locations and Driver Notes (Commercial Driver)
Commercial Driver users can share parking locations and leave notes and opinions about them. This content is written by users, is not verified by NextMate, and may be inaccurate, outdated, or incomplete. Endorsements such as "honks" show that other users agree with a note; they are opinions, not verification.
NextMate does not guarantee that any location is legal, safe, available, or suitable for your vehicle. Always follow posted signs and local law, and use your own judgment. NextMate is not responsible for tickets, towing, damage, theft, or loss connected to any parking location.
11. Road Alerts
Road Alerts are community reports and may be incomplete, inaccurate, or outdated. They are not a substitute for official road information, and they are not an emergency service. For emergencies, contact the appropriate emergency services.
When you create a Road Alert, your public username, the alert’s location, and any description or photos you add are shown to other users. Alerts may be confirmed or marked as cleared by other users and may expire or be cleared automatically. Any user may flag an alert for review. Do not submit false reports, and never submit a report while driving.
12. Marketplace
The Marketplace is a community classifieds board where users list items for other users to browse. NextMate is not the seller, the buyer, or a party to any transaction. NextMate does not own, inspect, or guarantee any item; does not verify users, listings, or their claims; does not process payments; and does not provide escrow, warranties, or dispute resolution.
You are solely responsible for your listings and your transactions, including the accuracy of your descriptions, your right to sell what you list, applicable laws and taxes, and your own safety when arranging any exchange. Consider meeting in a safe, public place, and be cautious of requests for payment in advance.
You may not list items or services that are illegal, stolen, counterfeit, or unsafe, or cards, accounts, or credentials that do not belong to you. When you post a listing, you choose the phone number shown on it, which can be your profile number or a different one. That number is visible to anyone who views the listing, and other users may call or text you at it. NextMate is not responsible for calls, texts, or other communications between users. Your public username appears on your listings.
13. Driver Card (Commercial Driver)
Commercial Driver users can create a Driver Card: a QR code that another person, such as facility or logistics staff, can scan to see who you are, how to contact you, and, if you add one, which order you are at that location for. Everything on the card is information you entered into the App yourself.
The Driver Card is not a government-issued ID, a license, or any other official identification, and NextMate does not verify what it shows. A facility may accept it or refuse it, and NextMate has no control over that decision. Carry any identification and documents the law or a facility requires.
When you open your Driver Card, NextMate creates a new code and turns off any earlier one. A code expires automatically after a set time (currently 4 hours), and you can turn it off at any time. While a code is active, anyone who scans it can see what the card shows, even if they do not have NextMate. Treat the code like a key: do not post or send it to people you do not intend to share with. Anyone who photographs or screenshots it can use it until it expires or you turn it off.
The card always shows your first and last name, your phone number, and your vehicle’s type, color, brand and model, along with the last few characters of its plate. You can also add a company name and an order or reference number, which are optional. You are responsible for keeping the company name and order reference accurate and for clearing the order reference when a job ends.
Only show your Driver Card when you are safely stopped. NextMate is not responsible for how anyone who scans a code uses or shares what it shows, for scans that fail (for example, because of no signal or an expired code), or for any delay, refused entry, or loss connected to your use of the Driver Card.
14. Your Content
You keep ownership of the content you post, including listings, notes, Road Alerts, and photos. You grant NextMate a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the App and as needed to operate and improve it.
You confirm that you have the right to post your content and that it does not include another person’s private information. NextMate may review, remove, or restrict content that violates these Terms or is otherwise harmful, but is not required to monitor content. Reports and flags are reviewed at our discretion, and we do not promise any specific response or timing.
15. Notifications
If you opt in, NextMate sends notifications to your device, such as when a match is found. You can turn notifications off in the App or in your device settings.
16. Third-Party Services
The App relies on third-party services, including database and hosting, file storage, text-message delivery, and maps. The App may also link to third-party services. NextMate does not control those services and is not responsible for them, and their own terms and privacy practices apply to your use of them.
17. Intellectual Property
The NextMate name, logo, and application are the property of NextMate and its founders. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended personal purpose. You may not copy, modify, reverse-engineer, or redistribute the App.
18. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEXTMATE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY MATCH OR PARKING SPACE WILL BE AVAILABLE, OR THAT ANY USER CONTENT, ROAD ALERT, PARKING LOCATION, OR LISTING IS ACCURATE, LEGAL, OR SAFE.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTMATE AND ITS FOUNDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PARKING, TIME, OR PROPERTY, VEHICLE DAMAGE, TICKETS OR TOWING, TRAFFIC OR ROAD-CONDITION INCIDENTS, MARKETPLACE TRANSACTIONS, OR PERSONAL INJURY, ARISING FROM YOUR USE OF THE APP OR YOUR INTERACTION WITH ANY OTHER USER OR THIRD PARTY, INCLUDING ANY CONFRONTATION OVER A PARKING SPACE.
20. Indemnification
You agree to indemnify and hold harmless NextMate and its founders from any claim, damage, or expense arising from your use of the App, your content, your listings and transactions, your violation of these Terms, or your interaction with another user or third party.
21. Termination and Account Deletion
NextMate may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for conduct we believe is harmful to other users or the platform. You may stop using the App at any time and may ask us to delete your account and associated data by contacting us at the email below.
22. Changes to These Terms
NextMate may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
23. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Florida.
